PHILADELPHIA (February 2017) – The Philadelphia business law firm Jacobs Law Group PC is pleased to announce their commercial litigation attorneys recently won a significant victory by successfully arguing to have a dispute remanded from federal court to state court.
Jacobs Law Group represents a commercial real estate broker in litigation concerning commissions the broker had earned with respect to commercial real estate property in Philadelphia. The broker filed suit against the property’s former landlord and former owner in Philadelphia County Court of Common Pleas, claiming that, after the sale of their interests in that property for hundreds of millions of dollars, the defendants had failed and refused to pay the broker the commissions that it had earned.
The defendants removed the action from state court to federal court, contending that the federal court had subject matter jurisdiction over this dispute. Jacobs Law Group’s commercial litigation attorneys argued that the defendants’ notice of removal did not meet statutory requirements, and filed a motion requesting remand of the suit back to state court. The federal court granted the motion on Jan. 4, 2017, in a significant victory for the plaintiff.
